Introduction and Agreement Scope

Welcome to Dunn First LLC. These Terms of Service serve as the foundational legal framework governing all professional site clearing, dirt removal, debris hauling, and property preparation services that we proudly deliver to both our commercial and residential clients.

By requesting an estimate, formally booking a project, or permitting our operations crew to mobilize and begin work on your property, you formally acknowledge that you have thoroughly read, fully understood, and explicitly agreed to be legally bound by these comprehensive terms and conditions.

This agreement functions as a binding contract designed to safeguard the rights and responsibilities of both parties. It clearly establishes mutual project expectations, outlines strict financial responsibilities, and defines our operational safety liabilities to ensure a smooth, transparent, and professional working relationship from start to finish.

Service Scope & Execution

Dunn First LLC specializes in construction site preparation, thorough rubble clearing, spoil hauling, and material management. Our experienced operations team always arrives fully equipped with the right machinery and expertise to execute the precise tasks that were outlined, discussed, and mutually agreed upon during the initial project quote phase.

While our crew takes every possible measure to ensure pristine workmanship and careful execution on every job, unexpected subsurface or environmental site conditions can occasionally arise. Complications such as deeply buried debris, hidden concrete foundations, unmapped utility lines, or unexpected soil saturation often require immediate and necessary scope adjustments to keep the project moving safely.

Any major project alterations, additional hauling truckloads, or extra operational hours that are directly necessitated by these hidden obstacles will always be communicated to the client transparently before proceeding. Please note that these unforeseen complications may incur supplemental labor, equipment usage, or third-party disposal fees to adequately complete the required work.

Payment Terms

All project pricing is generated based on volume, material weight, labor hours, and equipment deployment estimates. Payment terms are strictly set as due upon completion of the contracted services unless alternative written arrangements have been established prior to project commencement. Dunn First LLC accepts major credit cards, corporate checks, and approved electronic payment methods. Invoices remaining unpaid past the designated due date may accrue late fees, and overdue accounts may be forwarded to formal collection services, with the client bearing all associated legal and collection recovery costs.

Cancellation, Rescheduling, and Mobilization Policy

We understand that construction schedules, weather patterns, and project timelines are subject to change. However, because our machinery and crews are scheduled in advance, we require a minimum notice of 24 hours for any project cancellations or rescheduling requests. Cancellations submitted with less than 24 hours notice, or instances where our crew arrives onsite and is unable to perform work due to client unavailability or site restrictions, will be subject to a standard mobilization and trip fee to compensate for lost operational time and fuel costs.

Refund and Satisfaction Policy

Due to the intensive physical labor, heavy equipment fuel expenditures, machinery wear and tear, and third-party disposal facility tipping fees that are inherently associated with construction site clearing and debris removal, all sales and service fees are strictly final once physical work has commenced on your property.

We take great pride in delivering top-tier service quality and ensuring client satisfaction. If you notice any discrepancy or perceived oversight in the completed cleanup work, you are required to notify our management team within 24 hours of service delivery; upon notification, we will review the concern and, at our sole discretion, dispatch a crew back to the site to rectify valid issues pertaining strictly to the original scope of work.

Client Responsibilities, Access, and Utility Liability

The property owner or authorized contractor holds full responsibility for providing unobstructed site access for heavy trucks, dumpsters, and earth-moving machinery. Furthermore, the client must ensure that all underground utilities, private lines, septic systems, irrigation pipes, and property boundaries are explicitly identified, flagged, or professionally marked prior to the arrival of our team. Dunn First LLC accepts zero liability for damage caused to unmarked, misidentified, or shallowly buried private utilities, property markers, or un-reinforced concrete surfaces during standard operational clearing.

Limitation of Liability and Site Hazards

Construction sites and overgrown lots inherently present workplace hazards, including uneven terrain, loose rocks, sharp debris, and heavy vehicle traffic. While our crew maintains professional diligence, Dunn First LLC is not responsible for pre-existing structural weaknesses, surrounding landscape settling, or minor turf disruption caused by heavy machinery weight necessary for proper execution. Clients agree to hold Dunn First LLC harmless from incidental damages resulting from standard, non-negligent operational procedures required to complete the agreed project.
